This website, https://www.reflexologyasr.com/ ("Site"), is owned and managed by the Atlantic School of Reflexology (ASR), a registered career college in New Brunswick, Canada. The owner of this Site and its directors, agents, teachers, employees, and affiliates assume no responsibility or liability for any consequences resulting directly or indirectly from any action or inaction you take based on the information found on the Site or material linked to this Site. Any information on this Site is provided for promotional or informational purposes only and must not be relied upon as professional advice. By using this Site, you accept and agree that following and using any information or recommendation provided is at your own risk.


It is your responsibility to read these Terms and Conditions ("Terms") carefully before using our Site or purchasing or accessing any of our services, products, free or paid offerings, content, webinars, courses, or resources (collectively, "Services"). Your access to and use of this Site is subject to these legally binding Terms, which you accept and agree to by accessing this Site. By purchasing or accessing any Services, you further warrant that you are at least 18 years old or the applicable age of majority in your jurisdiction. Purchasing or accessing our Services, if you are a minor, is a violation of use, and we reserve the right to terminate your access if it is discovered that you are a minor.


Privacy Policy

We respect your privacy and allow you to control the treatment of your personal information. A complete statement of our current privacy policy can be found in the footer of the Site or on the Privacy Policy link. All questions and inquiries should be directed to info@reflexologyasr.com.


Ownership of Intellectual Property Rights

All content, resources, materials, images, text, designs, graphics, page layouts, icons, videos, logos, taglines, trademarks (whether common law or registered), copyrights, and service marks ("Intellectual Property") on our Site, Services, or posted on social media are owned by us unless otherwise attributed. All content on the Site and in any Services is proprietary to us, and you may not modify, whether in whole or in part, our Intellectual Property as this is a violation of federal law. Copyright law applies.


You are strictly prohibited from using our Intellectual Property in any way, including re-posting or republishing any of our Intellectual Property to any third-party website or social media platform for any purpose whatsoever.


Use of License

If ASR has materials on the Site that you can download, permission is granted to download and print copies of the materials for personal, non-commercial viewing only. This is the grant of a license, not a transfer of title, and under this license, you may not:

  • share any course materials (printed, video and online);

  • copy, modify, reproduce, re-publish, sub-license, sell, upload, broadcast, post, transmit or distribute any of the course materials without prior written permission from ASR;

  • record or relay by any means any part of the course;

  • use the course materials in the provision of any other course or training given by any third-party trainer;

  • remove any copyright or other notice of ASR on course materials.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by ASR at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession, whether in electronic or printed format.


Third-Party Websites

This Site may contain links to third-party websites. All such linked sites, materials, and pages are not under the control of ASR, and ASR is not responsible for the content contained in any linked website nor for any losses or damages you may incur as a result of the use of any third-party website. Atlantic School of Reflexology accepts no liability for any errors or omissions contained in third-party websites. These links are provided to improve your use of this Site, enable you to connect with Atlantic School of Reflexology on various platforms, help Atlantic School of Reflexology offer the most accessible services for you, and conduct transactions.

 

Fees

The fees listed on our Site are in CAD. International students are responsible for converting course fees to their local currency. Financial institutions may charge additional foreign transaction fees, which the students must cover.

 

The fees paid allow only the person purchasing access to a time-limited, non-transferable, single-use license of the course materials for the sole purpose of completing the online course and/or attending the taught course.


We reserve the right to change our Fees at any time and without notice. Payment in full is required to confirm and reserve your course(s).


Refunds

For digital products and courses, all sales are final. All course fees are 100% non-refundable and non-transferable. There will be no refunds.

Students must ensure that they can attend and commit to class times scheduled in Atlantic Standard Time (Halifax, Canada). It is the student's responsibility to convert class times to their local time zone.


We guarantee access to online course materials for the duration of the program stated in the individual program terms and conditions.

 

International Students

International students are responsible for ensuring the training is relevant to their particular location regarding potential legalities or regulations for practice, professional association membership in their area, etc. Our courses, materials, and examinations are delivered in English. Your English comprehension must be adequate to understand medical terminology and keep up with the fast pace of the courses. We do not offer translation services.


International students must ensure their country or region supports Zoom, the video conferencing application used for our online courses. At the last update, the following countries or regions were unable to access Zoom for regulatory reasons: Cuba, Iran, North Korea, Syria, and Ukraine.


Disclaimer

Any information and services provided on or through the Site are only for informational and educational purposes. The information and education are not intended to replace or be a substitute for professional medical advice, diagnosis, or treatment that your physician, nurse practitioner, or physician assistant can provide.


To the fullest extent permitted by law, we expressly exclude any liability for any direct, indirect, or consequential loss or damage incurred by you or others in connection with the use of our Site or the Services, including, without limitation, any liability for any accidents, delays, injuries, harm, loss, damage, death, lost profits, personal or business interruptions, misapplication of information, physical, mental, emotional, or spiritual injury or harm, loss of income or revenue, loss of business, loss of profits or contracts, anticipated savings, loss of data, loss of goodwill, and for any other loss or damage of any kind, whether caused by negligence, breach of contract or otherwise, whether foreseeable or unforeseeable.


No Guarantees

We make no guarantees about any particular results or benefits that you'll get from our Site or our services. We make no guarantee as to the accuracy of any third-party statements or the likelihood of success for you as a result of any statements or testimonials contained on our Site or as part of the Services. The testimonials, statements, and opinions presented on our Site are the results of the individuals who provided them. The results and experiences of each individual may vary. All testimonials provided on our Site were voluntarily provided without payment or in exchange for any compensation, including free Services unless expressly indicated otherwise.


No Warranties

We make reasonable efforts to provide you with modern, reliable technology, software, and platforms from which to access our Site and Services. In the event of a technological failure, you accept and acknowledge that we are not in any way responsible or liable for said failure and any resulting damages to you or your business. In no event shall ASR or its affiliates be liable for any damages (including, without limitation, damages for loss of data or profit or due to business interruption) arising out of the use or inability to view or use the materials or content on the Site, even if ASR has been notified orally or in writing of the possibility of such damage.

We make commercially reasonable efforts to protect your information. However, we cannot guarantee the security of your personal information transmitted to our Site. Any transmission of personal information is at your own risk. We are not responsible for any circumvention of the privacy settings or security measures on our Site. If you are required to create a username and password to access any Services, it is your responsibility to protect your username and password from theft or any other means of unauthorized use that would violate these Terms.


Governing Law

Any claim relating to ASR or ASR's Site shall be governed by the laws of the Province of New Brunswick without regard to its conflict of law provisions.


Indemnity

As a condition of your use of this Site, you indemnify ASR and its directors and affiliates from and against any and all liabilities, expenses (including legal fees), and damages arising out of claims resulting from your use of this Site.

 

Entire Agreement

These Terms and any other legal notices, policies, and guidelines of ASR linked to these Terms or contained on this Site constitute the entire Agreement between you and ASR regarding your use of this Site. They supersede any prior understandings or agreements (whether oral or written), claims, representations, and understandings of the parties related to such subject matter. This Agreement may not be amended or modified except by ASR.


If a court of competent jurisdiction finds any provision or portion of these Terms unenforceable, that provision or portion shall be enforced to the maximum extent permissible to reflect the parties' intent, and the remainder of these Terms shall continue in full force and effect. Failure by ASR to enforce or exercise any provision of these Terms shall not constitute a waiver of that right. Paragraph headings are for reference only.


If we believe that you have violated these Terms, we may terminate your use of our Site, Services, and any related communications immediately, as we deem appropriate and at our sole discretion. We may block or revoke your access to our Site and Services without notice and, if necessary, block your IP address from further visits to our Site.
